Sec. 1. 12 MRSA §7409 is enacted to read:

§7409.__Application of possession limits

A possession or bag limit established by rule does not apply to any game legally taken once that game is removed to and stored at the legal residence of the person who took the game.

Sec. 2. 12 MRSA §7604, as amended by PL 1979, c. 723, §29, is repealed and the following enacted in its place:

§7604.__Violation of number, amount, weight or size limits

1.__Violation.__A person is guilty of a violation of a number, amount, weight or size limit if that person fishes for or possesses fish in violation of the number, amount, weight or size limits set in any rule adopted by the commissioner.

2.__Exception.__A possession or catch limit established by rule does not apply to any fish legally taken once that fish is removed to and stored at the legal residence of the person who took the fish.

SUMMARY

This bill provides that any possession, bag or catch limit set by rule for fish and game does not apply for fish and game legally harvested and removed to the legal residence of the person harvesting the fish or game.
