An Act To Reduce Open Burning in Neighborhoods

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 12 MRSA §9325, sub-§1, ¶F,  as amended by PL 2001, c. 626, §7, is further amended to read:

F. Open burning of leaves, brush, deadwood and tree cuttings accrued from normal property maintenance by the individual landowner or , a lessee of the land or a commercial business that removes such items from residential properties to burn at the commercial business's primary business location unless expressly prohibited by municipal ordinance . A permit for open burning at a commercial business's primary business location may be issued only 4 times per calendar year;

Current law allows individual landowners and lessees who have obtained applicable permits to conduct open burning of leaves, brush, deadwood and tree cuttings. This bill extends authorization for open burning of such items to a commercial business that removes those items from residential properties to burn at the commercial business's primary business location.
